COUNCIL PRESIDENT GAMBER I d like to welcome all of you to Massillon City Council for Monday, April 17, 2006. We have in attendance with us this evening: Mayor Cicchinelli, Safety Service Director Loudiana, Auditor Hamit, Community Development Director Aane Aaby, and John Simpson from the Law Department. On the wall to your left are agendas for anyone who wishes to follow the meeting. Also under item #5 on the agenda is where the public can speak on any item that appears on the agenda and then under item #17 is where the public can speak on any item that does not appear on the agenda. I d also like to remind anyone with a cell phone please turn it off or turn it very far down.
1. ROLL CALL
Roll call for the evening found the following Council Members present: Tim Bryan, Kathy Catazaro-Perry, Jayne Ferrero, Chuck Maier, Ron Mang, Paul Manson, Dave McCune, Donnie Peters and Tony Townsend.
Thus giving a roll call vote of 9 present.
2. INVOCATION
COUNCILMAN MANG introduced Father Gretchgo from Saint Mary’s Church led the invocation for the evening.

5. REMARKS OF DELEGATIONS AND CITIZENS TO MATTERS ON THE AGENDA
TROY ENSMEAR – I live at 134 23rd Street SE. I’m here for the second time to state my opposition to allow the rezoning of the south side of Lincoln Way particularly as it pertains to Mr. Oser rebuilding that area commercially. I found it interesting Mr. Oser came to my house the other day and we had a nice chat. He showed me pictures of at least the proposed bank for that area a front view only. I happen to live on what would be the back side of his proposal. I found it also interesting that I don’t know if he himself is planning on building the structure, but no one else had approached me about what the back side might look like. I’m afraid that it’s going to encroach on our neighborhood and I’m also afraid that it’s not going to be maintained very well. A cell phone place we’ve got dozens of them, there’s no guarantee that is going to be maintained and it’s not going to change hands a thousand times. I really wish that this would be voted down. Thank you.
DALE MAURER – 129 25th Street SE, Massillon. I’d just like to make a couple comments in regards to what Mr. Oser said about a home next to me which I thoroughly agree with him. I’d also like to say that Mr. Carl Oser gave me a phone call before the Planning Commission Meeting even we went to that. He wanted to sort of ask for my support in favor of what he was going to accomplish or try to accomplish. I told him at that time that our neighborhood since this is all started from 21st Street up to 26th Street all of us neighbors have stuck together in regards to having this changed to rezoning for commercial. I told him I haven’t talked to any of the neighbors since I think the last time maybe we were done here in 1999. I told him at that time that when I talked to the neighbors if they are still under that same opinion of not having it rezoned that I am going to stay with the neighbors because we have all stuck together whether its up at my end close to 25th Street or if its down at the other end. As you can see we’re still sticking together and again we ask you people to not be in favor of rezoning. Thank you again very much.

COUNCILMAN MANG .I’d like of council to move Ordinance No. 47 and Ordinance No. 49 up to the first part of the agenda.
ORDINANCE NO. 47 2006 BY: COMMUNITY DEVELOPMENT COMMITTEE
COUNCILMAN MANG .We did have a public hearing here for this Ordinance No. 47. We had a couple individuals 3 individuals who addressed council. Two of them were very thankful for the money that has been allotted to them. As I explained at that time that I would be asking council to table this for reasons that in the advertisement that we had in the paper it stated that we would accept comments through April 30th.
COUNCILMAN MANG moved to table Ordinance No. 47 – 2006 until May 1st 2006, seconded by Councilman McCune.

ORDINANCE NO. 49 2006 BY: COMMUNITY DEVELOPMENT COMMITTEE
COUNCILMAN MANG .Ordinance No. 49 also had a public hearing tonight at 7:00pm. I think all of council was here to listen to the remarks of the owner of the property and listen to the neighbors in the existing area. I think we all had the opportunity to hear both sides and this piece of legislation had its third reading. I’m asking you to consider this in good conscious what you think should happen. I will be asking to bring Ordinance No. 49 – 2006 forward for the question of its vote.
COUNCILMAN MAIER – Yes, after hearing all the comments earlier I did talk to the Jones and they do live in that 300’ radius. I respect the Jones and their opinions they’ve live there for quite some time. My personal opinion is there is business on the north side there is also business on the south Burger King, there’s some banks up there and so forth. But I’m going to have to respect the wishes of the neighbors tonight and vote this down when it comes up.
COUNCILWOMAN CATAZARO-PERRY I would like to go on record saying again that you did not receive a letter in the mail from you councilwoman because it wasn’t necessary to rush into that. The only time I’ve ever in the 2.5 years that I’ve been a councilwoman sent a letter was this year to the people that lived on Harsh Avenue and Kaylynn. Because it was brought from the west side so quickly and those people had no idea. You all have had a chance to come to the three readings; you’ve had a chance to come tonight to the public hearing. So this isn’t something common to send a letter out. I just want my residents that are here tonight to know that. If it was something I think you would be concerned about you would have received a letter. This second thing I’d like to say is Mr. Climer did quote me as saying “that this is not my neighborhood” for the other project that I voted no on and again I’m going to tell you tonight this not my neighborhood and I will be voting no.
COUNCILMAN BRYAN – I wanted to say that and I’ve been a part of this for quite awhile too having had this and properties that adjourn or are on the same side of Lincoln Way being up for rezoning during the 16 years or so that I’ve been around here. First of all, I will be voting no, but I also want to point out that some of the things that Carl and his attorney said you know there is some argument on their side. I hope that he residents will think about the fact that their not going to build houses up there again. Try to maybe come to some conclusion as to what they would accept being built on that ground. Because it’s never going to be big single family houses again. You know if its multi family if you know if you preferred to see apartments built there I mean that’s up to you. What you would feel would be a minimum impact type of project that you could live with. I think at one point in time the development that was proposed was an office building and if I remember right and I could be wrong because my memory isn’t perfect. But the neighbors objected to the office building project also. I understand that its not my neighborhood and I’m not going to tell you what to do, but at some point I think the issue of what gets put on the land from whatever it is 21st to 25th Street there will need to be resolved. The best thing I think is if Mr. Oser and the neighbors could come to some realistic compromise on the thing. But that being said you know I wasn’t elected to city council to shove things down the people who elected me throats. So I’m going to vote no on the rezoning.
COUNCILMAN MANSON – Yes, I wanted to also say that you know I intend to vote no on the rezoning. Just I think Mr. Oser is taking this extremely personal, but I don’t look at it that way I look around the city how we’ve operated in the past as far as zoning and rezoning and stuff like that. I think we’ve been some what consistent I’ve seen this happen on my side of town. Had a small business area there and a new person bought it and they wanted to rezone some residential behind it and it got vetoed and it got rejected by council one time. Also saw a piece of property at the corner of 30th Street on the west side of Massillon that a developer wanted to rezone as a business or whatever B-1 I believe. He dropped that plan for the same reason the residents resisted it. I feel overwhelmingly the residents of this neighbor have shown that they don’t they are not interested in this development. This area was residential still is residential and I do believe Mr. Oser has speculated in land and you know sometimes you buy stock you speculate you lose. I think he thought it was a matter of time he would eventually get this zone. I’m sorry these people have convinced me to stick with this exactly as it is. I suggest building condominiums up there it would be a great project. Having condominiums across from what is on the north side of that street I mean you have grocery stores, you have restaurants, you have retail it would be tremendous to redevelop it as residential. So that’s my suggestion.
COUNCILWOMAN FERRERO- Not only am I council at large, but I’m also a resident in your ward that you came here to represent this evening. I thank you all for taking time out of your busy schedules to come to speak to all of us. Because that is what we need and the people that called me on the phone and spoke to me personally I’m very appreciative and I will be supporting the people of the ward and I will be voting no.

ORDINANCE NO. 60 2006 BY: PUBLIC UTILITIES COMMITTEE
COUNCILMAN MCCUNE .Yes, this is as you know from our work session an audit or study that the city would like to do on their telephone lines what lines are being used, what lines are not being used in an effort to weed through the unneeded lines and create a cost savings. Mary Beth took it upon herself and I’m very appreciative that she contacted some of the cities that they mentioned at our work session last week. Lorain is one that sticks out in my mind, Mary Beth spoke with the Safety Service Director up there they are it’s a risk free audit. They did identify $14,000.00 worth of savings through their study.
COUNCILMAN MCCUNE moved for suspension of the rules and passage, seconded by Councilman Manson.

ORDINANCE NO. 61 2006 BY: STREETS, HIGHWAYS, TRAFFIC & SAFETY
COUNCILMAN PETERS .Well, I wasn’t at the work session last Monday. I believe every one of you guys spoke about this. If there aren’t any questions I’m going to ask to wave the rules and pass this tonight.
COUNCILWOMAN CATAZARO-PERRY I do have a question about Wallace Avenue; it’s listed on here to be repaved. The residents have told me that road has been repaved over and over and I just wanted to know if that is true and if so why is it on the list again this year. If it’s not true then I guess I don’t have a question, but from what the residents have said they continually pave this street.
COUNCIL PRESIDENT GAMBER Who would you like to ask the question of?
COUNCILWOMAN CATAZARO-PERRY I guess Aane do you know if that’s true?
COMMUNITY DEVELOPMENT DIRECTOR AABY – I do not the list was prepared by the city engineer’s office. So I don’t really have any information on that. We can find out though.
COUNCILWOMAN CATAZARO-PERRY – Okay, maybe the Mayor may know.
MAYOR CICCHINELLI – If you give me time I’ll go through the list I have all the lists here from the last 18 years of street resurfacing. So if you give me a couple of minutes I’ll go through.
COUNCIL PRESIDENT GAMBER Do you have idea the distance of the project, Kathy?
COUNCILWOMAN CATAZARO-PERRY They just said you know when I went door to door they said again this past year in 2005 they said “well Wallace keeps getting paved do you know why that is?” Then I was just surprised that it was on the list again.
MAYOR CICCHINELLI – I have on my list it was paved in 2003, 2004. That’s from Wallace from 10th to Pine and Wallace from 5th to 10th.
COUNCILWOMAN CATAZARO-PERRY I’m not complaining I just would like to know.
MAYOR CICCHINELLI – No, is it on the list for CDBG? One thing to remember about CDBG and I’ll be quite honest with you if that’s the case and it looks like Mrs. Catazaro-Perry’s correct here that’s only a couple of years ago. We should really look into that unless there’s been a numerous cuts made into it. I don’t know utility cuts and you know they usually repair those and I said that tongue and cheek adequately. But sometimes it can break up easily, but if it was only resurfaced a couple of years ago. Unless the list I had maybe it was taken off. Let us look into it, if I may just quickly on these street lists. Please keep in mind the process used and its not the list that you see they’re prepared. It’s done in a way of the most need and what I mean by that we have people that go out and visit these streets. We have a list and inventory of all our streets and the engineering department goes out, the street superintendent goes out and they make the list. I know its part of the process I’ve asked, I ask all members of council to submit to the Administration the names of streets that they would like to see put on that list. If your streets weren’t selected it wasn’t mean it does not mean we were slighting you in any way. It’s just that the priorities that these streets attained or done by people that are independent of just saying “well, if a councilman submits a list of streets that means we have to automatically do them.” It goes by needs, what we’re really getting at now is all the streets in Massillon have been done once. We’re going to look at Wallace as to why it if it was done a couple of years ago why it’s back on the list and we’ll report back to you. But we don’t choose the streets to be done the only way its chosen is through people that go out and visit these streets personally. It could be coincidence that you have a lot of streets in the 6th ward being done this year. I can that’s why I brought my lists from the very beginning that we started resurfacing 18 years ago. Because they’re done on need that is all they’re done on. We aren’t going go to and try to equalize them in wards when the ward the particular streets in that ward are not needed to be resurfaced. We go by the greatest need and we’re done to the point where all streets were done once in cases maybe twice. What that tells you is that we’re in pretty good shape. But that all being said I know some of you are concerned because I’ve heard through the grapevine that none of your streets that you put on your list not everybody, but a couple of individuals were put on the list to resurface and it wasn’t because we don’t like you. It’s just those streets aren’t warranted to be put on the list by need. That all being said I’ll look for Wallace and if its I’ll check with engineering as to why they put it on the list. If it’s not needed then we’ll take them off the list, but hopefully we can still proceed with our resurfacing. Because believe me there’s other streets we can replace them with if that’s the case. But I appreciate your due diligence on it because that’s interesting it was done a couple of years ago.
COUNCIL PRESIDENT GAMBER Mr. Mayor, Mr. Bryan has a question.
COUNCILMAN BRYAN .Mr. Mayor, I’d like to request that you check all the streets on both lists. The CDBG list and the regular street resurfacing list because it seems to me and I don’t want to mention any streets because I don’t want to get anybody mad you know what I mean? But it seems to me that some of the streets on this list in my neighborhood have been done recently. I don’t want to go by memory cause you know my memory is not going to be perfect, but I would just like to request that you have somebody that double check all these streets to see that maybe that wasn’t some slippage in the number of years since they’ve been done.
MAYOR CICCHINELLI – Good point, Mr. Bryan, and I’ll do one better than that. Mr. Loudiana and I will personally tomorrow go to every one of those streets that are on both lists and we’ll report back to council.
COUNCILMAN MCCUNE .This is a little bit off of the list. I brought up at the work session and a couple of meetings ago about the Oberlin Road Bridge. There was to be a meeting and Mike was going to report back to us and since we have you up there I thought we’d see if you could report back to us on the status of that.
MAYOR CICCHINELLI – Yes, the city’s operation superintendent has met or talked to the County, The County and the City are going to work together to get that. It’s actually the maintenance belongs to the County. But that all being said we patched it a couple of times what we’re going to do is the County and the City are going to do it together. They have the larger roller and one of our rollers is out of commission; so we’re going to use their roller and I believe its been scheduled for later April sometime like in the late April or the last week of April. But they have tentatively set a meeting according to Mark where they’re going to go in together both the County and the City. Now with these different crews working together some times things change or the weather makes a change. But it’s going to be done and it will be done in a relatively short period time.
COUNCILMAN PETERS .No, I’ll wait.
COUNCILMAN MANSON Yeah, do you intend to strip them or what are they going to do to them the bridge?
MAYOR CICCHINELLI – Probably just more of a cover or some sort of a skim coat, but nothing it’s not going to be closed down. It’s scheduled I think 2009 to be actually re-decked and resurfaced whatever. So but it’s going to be just probably more like a skim coat. But it needs redone again and that bridge is ready to be done I think that’s the next one they’re scheduling and don’t hold me to 2009, but I think its sort…next thing is going to be Erie that we’re going to do.
COUNCILMAN PETERS .We’re just going to give this first reading tonight. Because until we get some of these questions answered I mean I’m not going to look for passage.
ORDINANCE NO. 61 2006 WAS GIVEN FIRST READING.
ORDINANCE NO. 62 2006 BY: STREETS, HIGHWAYS, TRAFFIC & SAFETY
COUNCILMAN PETERS Well, since we heard it through the grapevine that I was upset about the list I’m going to give this first reading also; because I am upset about the list. Just for the record, there’s 17 streets scheduled on the northeast side, 8 streets on the northwest side, 3 streets on the southeast side and 0 streets on the southwest side. I’m not very happy about that. There’s some streets in Baghdad that are in better shape than some of them on the west side. We need to look into this a little further.

COUNCILWOMAN CATAZARO-PERRY Before we go through all of the sections I’d like to make a motion to amend section 1. We originally had $30,000.00 for roof repair and the actual amount will be $33,000.00.
COUNCILWOMAN CATAZARO-PERRY moved for amendment of Ordinance No. 63 – 2006, seconded by Councilman Bryan.
ORDINANCE NO. 63 – 20056 WAS AMENDED BY A ROLL CALL VOTE OF 9 YES.
COUNCILWOMAN CATAZARO-PERRY The section 1 is $33,000.00 to repair the roof on the Annex Building. Section 2 is $15,000.00 from the General Fund for arbitrator services and contracts and that amount is for vital statistics remittance fees from the health department. Section 3 is $15,000.00 excuse me let me back up to section 2, section 3 is the health department I’m sorry $15,000.00 is for arbitrator services for section 2 and could I have Mr. Hamit, do you know exactly what this one is for the $15,000.00?
AUDITOR HAMIT – That’s the section in the health department. They collect monies for doing certain tests over there…and it has to distributed back to the state. The State gets a portion of that money.
COUNCILWOMAN CATAZARO-PERRY I think that’s section 3. Section 2 is $15,000.00 for arbitrator...
AUDITOR HAMIT – Section 2 is (inaudible) that the Administration has hired a legal individual for negotiating city contracts.
COUNCILWOMAN CATAZARO-PERRY Thank you; that’s what that is I just wanted to make sure. That is for the contracts that we are having with the unions and that’s $15,000.00 for section 2. The section 3 $15,000.00 is for the vital statistics for the health department. Section 4 is $5,000.00 for the Parking Enforcement Fund and that is for the SARTA deck that we have contracted for. I would just like to make that clear we had a question about that the last time. I believe that was for 1 month. May I ask Mr. Loudiana to approach the podium to clarify that?
SAFETY SERVICE DIRECTOR LOUDIANA – Yes, that was for 1 month our share of the bills for that building.
COUNCILWOMAN CATAZARO-PERRY Thank you and then the last one on this ordinance is $800.00 to services and contracts and this is for the Economic Development for locating the plat for Indian River Road and Big Indian Drive Southwest. I will take any questions that council members may have.
COUNCILMAN BRYAN .Yes, may I ask the Safety Service Director a question about their roof repair? You told me just a second ago you put that out to bid then you got some bids back.
SAFETY SERVICE DIRECTOR LOUDIANA – Yes, we got three bids. The highest bid was $37,520.00 that was from the roofing company it’s called Roof Replacement Company. I think they’re out of Cleveland, then there was 1 for Hal Jones Roofing which is out of Canton and then there was a Boeck and Sons. Theirs was $29,972.00 however they didn’t bid according to the specs. So we had to go to the next bidder which was $32,764.00.
COUNCILMAN BRYAN .What are we replacing the roof or repairing the roof?
SAFETY SERVICE DIRECTOR LOUDIANA – Yes, we’re replacing the entire roof on the Annex and also taking a big air conditioning unit off of there that’s been sitting up there for years.
COUNCILMAN BRYAN .Going with a regular build up roof or rubber roof?
SAFETY SERVICE DIRECTOR LOUDIANA – Yes, this roof the reason we specked it out we wanted to match the other part of the Annex which is a white membrane it’s been done for several years hasn’t been any problem. The one in the front if you’ve ever been in the building department the walls are all peeling and we’re getting a lot of leaks up there. We tried to patch it and we haven’t had any luck. So it’s been recommended that we just put a new roof on.
COUNCILMAN BRYAN .We getting any kind of warranty, do you know?
SAFETY SERVICE DIRECTOR LOUDIANA – 10 years.
COUNCILMAN BRYAN .Thank you, Mr. Director.
COUNCILMAN MAIER .Yes, under section 4 the $5,000.00 for the parking deck over there. When we got a bill last year it was for 30 some thousand dollars for back
SAFETY SERVICE DIRECTOR LOUDIANA – That was for 5 years.
COUNCILMAN MAIER .That was for 5 years, so with $30,000.00 for 5 years; $5,000.00 for one month would be $60,000.00 that’s a lot of money.
SAFETY SERVICE DIRECTOR LOUDIANA – Yeah, I think that’s a transfer just to put money in there. I think the bill this time was only like $1,600.00. I don’t have the actual bill, but she transfers that in there.
COUNCILMAN MAIER .Okay, I was because you said it was for 1 month I was a little confused there.
SAFETY SERVICE DIRECTOR LOUDIANA – Yeah, that was my fault. I’ll double check it, but I’m sure that’s what it is; $5,000.00 is pretty high. That’s probably the cost of the entire bill, but we split it 3 ways.
COUNCILMAN MAIER .It shouldn’t be more than it should probably cover the whole year almost. If it was $30,000.00 for 5 years.
SAFETY SERVICE DIRECTOR LOUDIANA – Yeah, we putting in new electric eyes to cut down the power consumption, we’ve cut down on the heaters, we going to clean the building this next month high pressure sprayer which needs done. There’s a couple other things that we’ve got to do there that we’re not sure we had some problems with the stairways with people camping out in there. So we’re going to clean those now too.

COUNCILMAN BRYAN .At our work session, I had requested that we could go into executive session with the Safety Service Director to discuss a couple of the contract negotiations with a couple of the bargaining units in particular the fire department I guess for the sake of the press and the public and the street department. I just wondered if we could that at this time or when you wanted to do that.
COUNCILMAN BRYAN moved to adjourn into executive session which the Safety Service Director, Mayor, any member of the city Administration whose present would like to attend and the Clerk for the purpose of discussing contacts with the 2 bargaining units that fire department and the street department, seconded by Councilman Manson.

COUNCILWOMAN CATAZARO-PERRY City council members had the opportunity at our work session last week to discuss capital improvement list and 2 of these items were on there. The street department capital improvement equipment that’s the street sweeper for $119,255.00 and then fire department repairs at $65,000.00 from section 1. Section 2 is $39,928.00 to fingerprint technology upgrade and I do believe they received a grant for these dollars as well. Section 3 is $8,750.25 and that is for legal work done for the JED and unfortunately our law director is not here this evening to answer any questions that council members may have. This was the JED for I believe Bricker and Eickler legal advisors to the city did this. I believe it was for Navarre and Perry is that correct, Aane? Yes, he’s shaking his yes. So unfortunately we don’t have him to answer questions, but possibly Aane could if anyone has any. Section 4 is just to bring this forward for its vote.

COUNCILWOMAN FERRERO – I have questions for Mr. Peters. I had 1 complaint about the ambulance noise on Main Street since the new people have started. There was a nice article in the paper about it and I’ve only had 1 complaint and I was just curious if you’ve gotten any complaints?
COUNCILMAN PETERS No, I haven’t. But I mean I think that’s kind of ridiculous I mean not saying you that’s the most ridiculous thing I’ve ever heard. You hear ambulances go by no matter where you live in town when they’re going to an emergency.
COUNCILWOMAN FERRERO – Well, they live right there. They said that you know as soon as they hit Main Street then they hear the noise and they hadn’t before. I explained that to them, but I just wondered if you had gotten any…
COUNCILMAN PETERS But maybe we can talk to them and maybe we can ask them if wait till they get 2 houses away before they turn it on. I don’t know
COUNCILWOMAN FERRERO – Well, I mean I don’t even know if they can do that. But I just wondered if you had any other complaints.
COUNCILMAN PETERS No, I haven’t had any complaints. Matter of fact, my neighbor lady just called me tonight she fell down today and broke her leg and the ambulance was there before the rescue squad and she’s like praising the city because she thinks that’s a great idea because it’s 1 block away from her house and you know she had a bad fracture. So you know I think that’s working out pretty good so far from what I’ve heard. Anyways, I hope that answers your question I haven’t had any other complaints.
COUNCILWOMAN FERRERO – I thought it was it was a very nice article in the paper that they did a very nice write up on it and they’ve gotten some exposure. So that was I only had 1 person bring it up to me and I just wanted to ask you.
COUNCILMAN PETERS Well, thank you because we can definitely ask them what they can do about that.
COUNCILMAN BRYAN I just wanted to say I’ve lived I think its 19 years with No. 3 fire station in my backyard and you get used to it.
COUNCILMAN MANSON - I’m saying that I’m glad that we have an ambulance service on the west side of town. It’s got to help out.
17. REMARKS OF DELEGATIONS AND CITIZENS TO MATTERS NOT ON THE AGENDA
DARLENE KLINK - 211 15th Street NW, Massillon, Ohio. First of all, I would like to publicly applaud the Mayor if last week’s report was right in the newspaper of him being very cautious in proceeding with this casino resort agreement with the Eastern Shawnee Indians. I do applaud him for that and I think he should be commended for being very cautious. I do hope also that the council members will continue to proceed with caution it was just in the news last week in North Dakota on the Indian reservation they are they have announced plans to open an abortion clinic. I think these are things that we here in Massillon should be considering as well that as you’re looking at dealing with the Eastern Shawnee Tribe and allowing our city to become a federal government land exactly what we would be opening our doors to. I also brought with me this evening and Mary Beth probably would have given them to you. I do have 91 total concerned citizens in the areas and of those 61 are residents that are opposed to a casino coming to Massillon. Thank you.
MAYOR CICCHINELLI – Just quickly, Mr. Peters, what I would suggest maybe you and I and Mike sit down if you like this week and go over your list. We certainly want maybe what we can do is go over all the lists from the beginning is to when the streets in the 5th ward were done. I don’t want the people of this community to think that we put these streets and any other list but a priority list. Another words, we don’t go by anything but prioritizing and other people go out and look at these streets. I would also like to tell you that if you look at our target streets for 2006 of the 5 that are mentioned 3 are in the ward. Also maybe people have forgotten this, but if you remember our 2005 resurfacing list and program was held off from last year it will be done this year. So they should start that pretty quickly and in that there are 2 streets in your ward Bebb from Duncan to 8th and Overlook from 9th to Duncan. I believe Overlook was on your list that you submitted to us.
COUNCILMAN PETERS I asked for that list several times to you know before I started jumping somebody. I’ve never gotten that list of last year’s funds. So I had no idea that.
MAYOR CICCHINELLI – Okay, well, I don’t know who you asked. But I think we need to just sit down, but I think after you go over the entire 18 year process you’ll see that we’ve done a lot of streets in all the wards and we don’t prioritize them by this section, that ward, this area. Its done on need, but you have to keep in mind sometimes CDBG we can’t spend those dollars in certain areas of town. So that limits us and maybe that’s why that street is on the list again to be done Mrs. Catazaro-Perry’s right we’ve got to look into that especially if it was done. Aane and I were talking at the break and the only thing that maybe happened there were 1 or 2 streets taken off that list before that’s some times happen. But we want to go and we want to look and see actually when they were done and solidify the list and it’s probably best that you are giving it 1 reading tonight. But we’ll be back on May 1st hopefully we get your blessings then. But why don’t you schedule something with Mike and I and be more than happy to go over all this and hopefully you’ll be satisfied after we explain everything to you.
COUNCILMAN BRYAN .Mr. Mayor, I do hope though that you will do exactly what you said you would do and you and Mike will go over the entire list and double check.

HERBERT HUFF – I live at 1184 Bradford Road NE, Massillon. Just wanted take a minute to clear up a misconception as a result of an article that appeared in the Independent a couple days after last 2 weeks ago at the council meeting. Related to an article that was entitled “Professor says crime, casino not connected” in that article I was quoted as saying “Massillon resident Herbert Huff cited statistics about how crime Gulfport, Mississippi” then it goes on to talk about different categories of crime and particular statistics associated with them. If you read the following day’s paper you’ll see that I did not make those comments. The Independent did print the correction pertaining to that and I felt strongly enough about it that I stayed home from work Wednesday until I could meet personally with the editor and the publisher to make sure that got done. What I do want to say is if you didn’t make that connection the tone of the article was about misuse of statistics in public hearings. I want you each personally know that everything that I have presented to you I can collaborate with sources and I’ve given them to you in form of copies. In addition to that I do have a Bachelor of Science Degree and Applied Mathematics. I’m very well capable of computing percentages. For Mr. Bryan in particular you were quoted in the article as saying “Councilman Bryan said something sounded unusual about those statistics which led him to do some research of his own.” Given that the article was an error to begin with and misattributing statistics that I didn’t give I’m not really sure what you were referring to. But I just want you to know if you have any questions about what I said or what I presented I’ll be glad to sit down with you or with any other member of council anytime to discuss those statistics.
COUNCILMAN BRYAN .I’m glad that Mr. Huff brought this up because there was the story was inadequate. What occurred was I was doing research on the crime statistics found this citation of Gulfport, Mississippi and a report done by the Attorney General State of Maryland and used this as an example of how statistics can be unscientifically applied. I did not attribute those numbers to Mr. Huff.
HERBERT HUFF – Right and the article doesn’t make that clear because it’s just your comments…
COUNCILMAN BRYAN .Sounded to me like I made that I can understand how you thought that. But I did not attribute those remarks to Mr. Huff because I didn’t remember who said it. I merely made this sort of a broadcast about this particular issue and I’m glad that Mr. Huff is here so we can get this straightened out because I did not remember him saying that I just remembered hearing it. If you’ve given me written you know typed written details and cited your sources I’ll go back and I will check your sources and look at them I guarantee you that.
HERBERT HUFF –I guarantee the sources are accurate and I do want to make 1 other point about the article and it collates what Mr. Okoboji said about the right way to do this. You do it based on population per hundred thousand. The statistics that I quoted you pertaining to Atlantic City and to Wheeling West Virginia were exactly that based on FBI crime statistics normalized for 100,000 in population. If I can make 1 more point I’ll make it short. Related to the same issue not to the article but to the casino gambling issue I know council has been inidated with information. I can’t imagine the folders that you probably have at home stacked with stuff that people have given to you. I’ve heard a lot of mention among council members about you know perhaps this should go to a vote of people. But I do want to ask you 1 question as council members you’ve been presented with more information about this topic than any individual citizen in this community can possibly hope to access. If you can’t make a decision regarding what you think is best for Massillon how can you expect the average citizen of Massillon to come to a reasonable conclusion and in particular trying to decipher the Intergovernmental Agreement. My personal feeling and I think others probably feel similarly is we elected you guys to make the hard decisions. We want you to make the hard decisions we want you to listen to the input from the public, but you have access to information that people will probably never see. You guys really need to get your heads together and make a decision in unison for the good of this community. Thank you very much.
COUNCILMAN MCCUNE – I would just like to address Mr. Huff in regard to his last statement. I’ve had numerous people approach me about they want the right to vote on this. I’ve stood publicly on numerous occasions and said that I believe that it’s council’s job to negotiate the best possible Intergovernmental Agreement that we can get out in our wards educate our constituents and let the people make the decision. I appreciate that you elected us to make those decisions but when it’s a face changing this Intergovernmental Agreement represents I think it’s the people who can make that call.
COUNCILMAN PETERS I’ll seconded that.
COUNCILWOMAN CATAZARO-PERRY Mr. Huff, I would like to say too that I think that if our Law Director isn’t comfortable looking at the Intergovernmental Agreement we do need to look at hiring someone to do that. I think we all feel and I’ll just speak for myself on that a lack of knowledge on that piece because we’ve not even delve into that yet. So you know I don’t mind reviewing that but we need to see if this law suit is even going forward. Then we can go from there. So thank you for your comments.
