COUNCIL PRESIDENT GAMBER I d like to welcome all of you to Massillon City Council for Monday, April 2, 2007. We have in attendance with us this evening: Safety Service Director Loudiana, Auditor Hamit, Bob Zadell from the Law Department, Engineer Dylewski. Police Chief Williams and Community Development Aaby. On the wall to your left are agendas for anyone who wishes to follow the meeting. Also under item #5 on the agenda is where the public can speak on any item that appears on the agenda and then under item #17 is where the public can speak on any item that does not appear on the agenda. I d also like to remind anyone with a cell phone please turn it off or turn it very far down.
1. ROLL CALL
Roll call for the evening found the following Council Members present: Tim Bryan, Kathy Catazaro-Perry, Jayne Ferrero, Chuck Maier, Ron Mang, Paul Manson, Dave McCune, Donnie Peters and Tony Townsend.
Thus giving a roll call vote of 9 present.

5. REMARKS OF DELEGATIONS AND CITIZENS TO MATTERS ON THE AGENDA
ROBB HANKINS – I live at 3968 Ashford Street NW in Canton. I’m here on the resolution to declare April 12 through the 22nd Stark Arts Festival Week in Massillon and the county. I passed out a hand out which might provide you with some helpful information. Some of you know that two years ago what used to be called the Cultural Center for the Arts went county wide to become the Stark Arts Counsel. As part of that we created a new grants program called special project grants. So what you have on the first page of that hand out is a list of some $63,000 in direct grants that have come into Massillon in the last 15 months. At the top of the page and at the bottom page is a list of some $62,000 grants which came to organizations that service Massillon. I guess I always start with that because I want you to know that some things have changed. For 38 some years there were no dollars coming into Massillon; so we think its good news in the spirit of trying to be a county arts counsel in the last year there’s been depending which how many columns you want to add 60 or $120,000. There’s a grass roots organization in the county called Stark ACT or Stark Arts Coming Together. Sometimes they get confused with us because we’re Arts in Stark the County Arts Counsel. But from April 13th through the 22nd we’re trying to shed light on all the incredible arts activities happening in this county 500 artists and craftsmen, 100 arts history and cultural organizations. So we’re just here tonight asking you to passing a resolution declaring that Stark Arts Festival Week and there’s a special free afternoon of arts activities on Sunday, April 22nd happens to be this year at Glen Oak High School 5 hours of free family art making activities. So we invite you to encourage your citizens to bring their kids and come try it out. That’s all I have to say I thank you so much for listening to my comments.
6. INTRODUCTION OF ORDINANCES AND RESOLUTIONS
ORDINANCE NO. 41 2007 BY: COMMUNITY DEVELOPMENT COMMITTEE
Application for the Community Development Block Grant Program.
COUNCILMAN MANG Members of council, we discussed this at some length in the work session. This is the annual CDBG program this will be for the fiscal year 2007. At the work session we went through the allocations that were made in 2006; you found that most of those if not all of them were funded again in the year 2007. There will be a public hearing held on this on April 16th at 6:30pm. We do have Aane here tonight and I’d be more than happy to engage in any conversations you wish about this. You have a public hearing on the 16th but it needs to be passed at the council meeting on the 7th at the latest because it needs to be filed on the 15th I believe of May. That still gives council the opportunity to inquire about making changes which you can do all within the program realizing that the amount of dollars that are available will change. But it’s conceivable that if you wish to make to move some of the money around you can do that. You can think about that if you don’t have recommendations tonight that’s one thing, but no later I think than next week at the next council meeting so that or probably at the work session would be even better to discuss about making some changes so that we can find out a little more about the program that you want to change because it will be a case of taking money out of one hand and putting money in another hand. I think you’ll probably want to know the reason for the asking and the reason why and Aane would be able to do that for us at our council meeting. If you have thoughts about something you want to do before that it would be a good idea that if you contact Aane and he’d be able to tell you what the application was for, what they asked for and what they intend to do. So tonight this will be given first reading.
ORDINANCE NO. 41 – 2007 WAS GIVEN FIRST READING.
ORDINANCE NO. 42 2007 BY: COMMUNITY DEVELOPMENT COMMITTEE
Rezoning a certain tract of land from R-T Two Family Residential and RM-1 Multiple Family Residential to R-1 Single Family Residential for further development of Ballinger Estates.
COUNCILMAN MANG Members of council, not often do you get a request for rezoning that has the recommendation of probably everybody. The recommendation of the people who live in the vicinity and undoubtedly I would hope the members of council. This request really is changing what is presently two family and multi family to single family. Another words, they would not need to go through this they could literally go ahead and build single family homes in that area, but as a protection for the people who might buy that home knowing that future homes that will be built in there will all be single family. So at the planning commission there was a number of people who spoke and they spoke highly of it due to the fact that it’s a win, win situation. We’ll have the first reading tonight and a public hearing will be scheduled on May 7th at 7:00pm and that falls in Tony Townsend’s ward.
ORDINANCE NO. 42 – 2007 WAS GIVEN FIRST READING.
ORDINANCE NO. 43 2007 BY: ENVIRONMENTAL COMMITTEE
Authorizing and directing the Mayor and the Director of Public Service and Safety to enter into the Recycling Program Grant Agreement with Stark-Tuscarawas-Wayne Joint Solid Waste Management District.
COUNCILMAN MANSON Yes, we discussed this at last week’s committee session. This is a grant for recycling and for composting, leaf composting, we’ve done this I think for several years now. I have a question of the Clerk, on the front it says $30,900.00, but the total is $89,919.00. I’m not sure if that is in there or needs to be in there.
COUNCIL PRESIDENT GAMBER Mr. Manson, do you have your legislation request attached to the ordinance?
COUNCILMAN MANSON Yes, I do and maybe I’m overlooking that somewhere.
COUNCIL PRESIDENT GAMBER What numbers are on the legislation request?
COUNCILMAN MANSON Well, the front on the ordinance it says $30.900.00, but then when you go to the recycling grant the next page it says $89, 919.00 and there are you know the legislation requests it says the grant is to be distributed as follows: $59, 019.00 for composting and $30,900.00 for recycling. So I’m not sure if we should have $89,919.00 in there. I’m sorry if…
COUNCIL PRESIDENT GAMBER Why don’t we call Mr. Loudiana up, Michael?
SAFETY SERVICE DIRECTOR LOUDIANA – That is, there’s two grants, one for $59,019.00 and $30.900.00 one’s for composting and the others for solid waste. So there should be two.
COUNCILMAN MANSON Well, that’s what I’m wondering if section 3 should be if we could just amend that to where it says $89,919.00 if that would be appropriate?
SAFETY SERVICE DIRECTOR LOUDIANA – Well, that’s up to council if you want to do it individually or they’re two separate grants.
COUNCIL CLERK MARY BETH – Last time we accepted the $30,000.00 on the last ordinance.
COUNCIL PRESIDENT GAMBER Madame Clerk?
COUNCIL CLERK MARY BETH – On the ordinance that we did last year it was $30,000.00 and this year it was $30,900.00. We just did the separate ones.
COUNCILMAN MANSON Okay, alright, well then we’ll do it the same way if we have a problem we’ll bring another ordinance back next week. Mike, would you like to give us a little explanation on this what all this is going to do for us?
SAFETY SERVICE DIRECTOR LOUDIANA – Yes, these are the grants that we get for the recycling place up at the garage and the other money is for the leaf pick up in the fall. It’ll pay the laborer and the disposal of the leaves so the $50,019.00 is for the leaves, the $30,900.00 is for the laborer at the city garage.
COUNCILMAN MANSON And the recycling station at the city garage what are the hours up there just in case anybody needs to know?
SAFETY SERVICE DIRECTOR LOUDIANA – They’re there till 6:00pm daily.
COUNCIL PRESIDENT GAMBER Are we squared away on the number then?
COUNCILMAN MANSON Yes, its fine.
SAFETY SERVICE DIRECTOR LOUDIANA – You’re doing what $80,919.00?
COUNCIL PRESIDENT GAMBER The ordinance is for $30,900.00.
SAFETY SERVICE DIRECTOR LOUDIANA – Well, what about the $50,000.00?
COUNCILMAN MANSON I think we should amend section 3 instead of saying $30,900.00 I think we should amend that to say $89,919.00.
COUNCILMAN BRYAN I agree with Mr. Manson, but in order to maybe having to avoid having to come back and do this over can we just take 5 minutes and ask Mr. Zadell to look it over since he’s here?
COUNCIL PRESIDENT GAMBER I was about to suggest that. Back to my original question on the legislation request that you had signed by the administration and the auditor what is the number on that request?
COUNCILMAN MANSON It’s got two numbers. The total is $89,919.00 it says grant is distributed as follows: $59,019.00 for composting, $30,900.00 for recycling.
COUNCIL PRESIDENT GAMBER We do have an exhibit “A” which is the entire contract for the recycling grant which mentions the $89,919.00. So I will entertain a motion for a 5 minute recess everyone just stay in their seats and we’ll discuss this with the law director. We’ll be in recess for 5 minutes. Mr. Manson, you have the floor?
COUNCILMAN MANSON Yes, I’m going to ask Mr. Zadell to come to the microphone please and give his opinion of what’s the best way is for us to handle this

BOB ZADELL – I took a look at this real briefly here. My understanding on the original request for legislation which I don’t have although Mr. Manson did show it to me; they had requested to two amounts there were two amounts listed on there. One was the $30,900.00, the other was $59,019.00. I think when we drafted the ordinance itself #43 – 2007 the amount should have been I believe the total amount instead of $30,900.00 because it should match what was requested in the beginning. Rather than couching that in terms of an amendment I would ask if it would be listed more as a correction.
COUNCIL PRESIDENT GAMBER Just call that a typo?
BOB ZADELL – I think it’s more a clerical error than anything else because nothing personal because the original request does have both figures on it. I think perhaps it would be best to have everything at least be consistent.
COUNCIL PRESIDENT GAMBER Alright, so the number that should be in section 3 is $89,919.00 is that correct?
BOB ZADELL – Is that correct, Mr. Manson?
COUNCILMAN MANSON Yes.
COUNCIL PRESIDENT GAMBER Alright, if everyone would please make that correction we do not need an amendment to this. We will just call it a clerical error.
COUNCILMAN MANG Could we just call that a misunderstanding of the legislation requests, I don’t like the word clerical error. Let’s just a misunderstanding…

COUNCIL PRESIDENT GAMBER We’ve had a request to move Resolution No. 3 to the next item on our order of business is there any objections. Mr. Bryan, you have the floor. Let me back up; let me have the Clerk read the title first.
RESOLUTION NO. 9 – 2007 BY: COMMITTEE OF THE WHOLE
COUNCILMAN BRYAN Forgive my voice tonight I’ve got this little upper respiratory thing going on. But as you heard before from the representatives of Arts in Stark a couple of years they expanded their operation from just supporting three organizations in Canton to doing grants in the whole county including Massillon which is a really good thing for our community. As he pointed out $60,000.00 has been granted to organizations in Massillon and the Massillon area. So although this event doesn’t happen in Massillon I’m really happy to support it because Arts in Stark is supporting Massillon therefore if there any questions or comments after which I will be glad to move for passage of the resolution.
COUNCILWOMAN CATAZARO-PERRY I would just like to thank Arts in Stark for the enormous amount of dollars that you have given to us in Massillon. You do impact many, many people and for me I would like to thank you.

ORDINANCE NO. 44 2007 BY: ENVIRONMENTAL COMMITTEE
Accept replatting of Parts of Out Lot 122, located between 14th Street NW and 15th Street NW, north of Auburn Avenue, in the City of Massillon.
COUNCILMAN MANSON Yes, we discussed this at last week’s committee session. This is a replat of two older lots into one larger building lot. There’s also a sanitary sewer easement, oh I’m sorry that’s I believe that’s sanitary and storm sewer easement on the side of this property. I discussed it with the engineer we really don’t have any problems with it right now.

Authorizing the Director of Public Service and Safety to advertise for and receive sealed bids for the lease/purchase of six (6) police cruisers for the Massillon Police Department.
COUNCILMAN MAIER Yes, We talked about this in the work session. The safety director and the police chief both believe that this needs to be done rather quickly so we can get something moving before the summer on these police cars with the high mileage we have on some of them.
COUNCILMAN PETERS Yes, Mr. Maier, in the work session we agreed to go out and advertise and receive bids correct, but did we take out enter into contact?
COUNCILMAN MAIER We took out “enter into contract” what we wanted to do was get the bids and see what the administration can get for bids and then come back and tell us where they would like to get the money whether it be from what fund you know I guess the we really haven’t received that part of our budget yet. So we…its not in the budget at this time so we’d like to see where they’re going to get it and if we have the money for the entire six (6) police cars we’ll do that if we don’t then after we receive bids we can see what we can buy.

Authorizing the Director of Law to renew a one year contract with the Stark County Public Defender’s Office for the purpose of providing representation for indigent defendants.
COUNCILMAN TOWNSEND – We discussed this last week during our work session. The passage of Ordinance No. 46 will allow the Law Director of Massillon to renew a one year contract with the Stark County Public Defender’s Office to provide services to indigent defendants who enter the Massillon court system.

Accepting the vacating a certain public alley located between Tremont Avenue SE and Vermont Avenue SE.
COUNCILMAN PETERS Yes, this alley is located between Tremont Avenue SE and Vermont Avenue SE running in an east/west direction between 16th Street and 18th Street. The alley is currently unopened and Gary Holderbaum is the person requesting this portion of the alley be vacated and all the adjoining property owners have signed a petition to have the alley vacated. We see no problem with that so if there aren’t any questions I’m going to put this forward for a vote.

Making certain appropriations from the unappropriated balance of the Local Law Enforcement Trust Fund, 1406 Wastewater Treatment Capital Improvement Fund and the 1206 Muni Motor Vehicle License Fund, for the year ending December 31, 2007.
COUNCILWOMAN CATAZARO-PERRY In section 1, we are going to appropriate from the Local Law Enforcement Trust Fund $25,000.00 to an account entitled supplies, materials and postage for a SWAT team. Chief Williams would like to start. Section 2, we’d like to appropriate from 1406 Wastewater Treatment Capital Improvement Fund $22,000.00 for storm sewer repair Championship Circle and $20,460.00 for a storm sewer repair on Colonial Parkway and Woodview. Section 3, we’d like to appropriate from the balance of the 1206 Muni Motor Vehicle License Plate Fund $3,100.00 for storm sewer repairs on Tennyson Avenue, and Section 4 is just creating an emergency for this passage of this ordinance.

COUNCILMAN TOWNSEND – I would just like to state that I have received a copy of the 2006 annual report from the office of the Massillon Municipal Clerk of Court.

ORDINANCE NO. 29 2007 BY: COMMUNITY DEVELOPMENT COMMITTEE
Authorizing the Director of Public Service and Safety to enter into a purchase for the sale of the Armory property to the Massillon City Board of Education.
COUNCILMAN MANG My remarks will be for both ordinances 29 and 30. You know, when this was first brought up I pretty much adamantly opposed selling the Armory to the Massillon Board of Education because I know the amount of time and energies and monies that was put forth. I was also upset due to the fact that we had a lawsuit that cost the city a fair amount of money to defend itself. I was critical of the lawsuit I understand there are times when lawsuits are necessary to get someone’s attention. Well, they got our attention, but I don’t’ think it had to go that far. In this case, the money that its paper money at this point we owe them and they in turn is going to forgive that I can live with that. The $100,000.00 I would like to see that be actually given to the Board of Education because of their monies they’ve spent. But as we’ve been discussing lately our CDBG fund and several members of council have indicated that they’d like to see some additional money maybe for a different organization or for an organization we presently have. So this will be an opportunity this $100,000.00 is going into that fund so if this body would see fit at some point yet in this calendar that could make adjustments with that $100,000.00. So I’m asking council to support Ordinance 29 and Ordinance 30.
COUNCILWOMAN CATAZARO-PERRY I did speak with Mr. Blosser on the telephone several weeks ago and he is in very much support of this ordinance. He said that had this gone any further dollar wise their board would have said no; but they love this right now and they’d like us to approve it. That’s from Mr. Blosser.
COUNCILMAN MANG Mr. Blosser don’t have my phone number I guess.
COUNCILMAN MANG moved to bring Ordinance No. 29 – 2007 forward for its passage, seconded by Councilman McCune.
COUNCILMAN MAIER Yes, I would like to be exempt from the voting because of the school board being my employer on both ordinances we can do it one at a time or we can do them both.
COUNCILMAN BRYAN I move that we allow Mr. Maier to abstain on both the Ordinances No. 29 & 30 due to the fact that he’s employed by the school board, seconded by Councilman Manson.

JAMES THOMAS – 563 Neale Avenue SW, Massillon. The deal is basketball courts on the sidewalk. They destroyed my property last year, year before last, is there a law that we could get these basketball hoops off of the road or sidewalk?
COUNCIL PRESIDENT GAMBER Alright, we will look into that is that your question or comments?
JAMES THOMAS – Yes.
COUNCIL PRESIDENT GAMBER Alright, thank you. Mr. Peters, you’d like to make a comment?
COUNCILMAN PETERS – Probably an answer to his question. Mr. Thomas called me on Saturday morning and told me of his concerns. He’s in my ward and I called the safety service director to see what was in place to stop such a thing and there is not an ordinance in place stopping the children from putting the basketball hoops there at this time. The safety service director told me that he would look into it and see if there’s anything we can do to help Mr. Thomas, but as of right now we can not do anything because there’s not an ordinance for it.
COUNCIL PRESIDENT GAMBER Mr. Thomas, if you would please keep in touch with Mr. Peters and the safety service director will see what can be worked out. Anyone else is invited forward.
GARY COLLIER - I live at 554 Neale Avenue. I’m here with the same thing he’s here for. I’m saying like if I went to the Mayor’s house and put that basketball court in front of his house and I started playing basketball at 10:00 at night, 12:00 at night. How long would it take them to get that basketball court off. That’s it.
COUNCILMAN PETERS – Mr. Loudiana, would you like to come up and comment on that.
SAFETY SERVICE DIRECTOR LOUDIANA – These basketball hoops are becoming a problem; we have trouble with them in the winter because they create problems when we’re plowing snow. This is the first time I’ve heard problems at night, we do have a noise ordinance and those things can be addressed. As far as the basketball hoops themselves we don’t have anything on the books right now to eliminate them that’s something we might want to consider with council on adding that to some ordinance that we have on the books now. But if you have problems at 10:00 at night or 11:00 at night or 12:00 at night with people out there making noise then let us know. We’ll take care of it, okay? Thank you.
COUNCIL PRESIDENT GAMBER If anyone would like to come forward? We appreciate you coming to council and hopefully we’ll get that worked out for you.
COUNCILMAN TOWNSEND – I don’t know if Mr. Loudiana can answer this question or if I should speak with Kenn Kaminski. I received several calls from residents wanting to know what well is someone going to clean up the area on the far end of the golf course. I believe there’s a lot of trees that’s been cut down and laid and they’re on the golf course there.
SAFETY SERVICE DIRECTOR LOUDIANA – We are cleaning that area up. Unfortunately, we can only do some much at once. We have other areas in town where we have to take care of emergencies on trees. The majority of those trees are taken out just were taken out what’s left is the debris there. That will eventually be addressed so just be a little patient.
COUNCILMAN TOWNSEND – I will.
COUNCILMAN MANSON Yes, I made the same complaint to Mr. Loudiana about 6, 8 weeks ago and I’ve been watching it very closely and they have taken some out they are working on it somewhat. It still needs more work though, but they have been working on it.
COUNCIL PRESIDENT GAMBER Mr. Townsend, please keep your eye on the progress of that. (Yes, sir) Yell if it doesn’t get done.
