MINUTES OF THE REGULAR MEETING
MASSILLON CITY COUNCIL
HELD, MONDAY, FEBRUARY 6, 2006
COUNCIL PRESIDENT GAMBER – I’d like to welcome all of you to Massillon City Council for Monday, February 6, 2006. We have in attendance with us this evening: Mayor Cicchinelli, Auditor Hamit, Law Director Stergios, and Fire Chief Layne. On the wall to your left are agendas for anyone who wishes to follow the meeting. Also under item #5 on the agenda is where the public can speak on any item that appears on the agenda and then under item #17 is where the public can speak on any item that does not appear on the agenda. I’d also like to remind anyone with a cell phone please turn it off or turn it very far down.
1. ROLL CALL
Roll call for the evening found the following Council Members present: Tim Bryan, Kathy Catazaro-Perry, Jayne Ferrero, Chuck Maier, Ron Mang, Paul Manson, Dave McCune, Donnie Peters and Tony Townsend.
Thus giving a roll call vote of 9 present.

COUNCILMAN TOWNSEND – gave the invocation for the evening.
3. PLEDGE OF ALLEGIANCE
COUNCILMAN TOWNSEND – Chairman of the Rules, Courts and Civil Service Committee led those in attendance in the Pledge of Allegiance.
4. READING OF THE JOURNAL
COUNCIL PRESIDENT GAMBER – Madame Clerk are the minutes of the previous meeting transcribed and open for public viewing (THEY ARE) Are there any additions or corrections to the minutes. If not the minutes stand approved as written.
5. REMARKS OF DELEGATIONS AND CITIZENS TO MATTERS ON THE AGENDA
SAM MILLER - I live at 612 Noble Place NW. I’d like to address council on Resolution No. 2 for senior housing development off of Noble NW. There is concerned neighbors both 32nd and Noble NW that are very concerned about this development going in. I would say we’re surely going to have some more meetings about this, but the majority of the neighbors on Noble at this point object to it being put in there. So just so it’s on the record this isn’t going to get passed as an emergency measure or anything. It’s going to get the three readings? (That’s correct). Okay, I just wanted you to know that we are out there.
KATHY BATES – 742 32nd Street NW. I’d also like to speak on Resolution No. 2 against the development on the 10 acres. I know that many people were at the junior high school and voiced many concerns about this. I also am hoping that this doesn’t happen for many reasons. I just wanted to voice my opinion.
BILL YATSKO – I live at 380 Noble for Ordinance No. 2. Am I correct in saying the empty lot they want to put a street on was not right for a street before it was swampy or something am I correct on that? (I don’t know Bill, but this is an opportunity for you to make a statement rather than ask questions.) Okay, I’m just asking because I think it was pertaining to it wasn’t suitable for a street between Noble and this allotment for a street that’s all I know.
COUNCIL PRESIDENT GAMBER – Okay, that may be.
DONNA YATSKO – 380 Noble NW. I too am here to say I’m against this.
6. INTRODUCTION OF ORDINANCES AND RESOLUTIONS
ORDINANCE NO. 13 - 2006 BY: COMMUNITY DEVELOPMENT COMMITTEE
COUNCILMAN MANG – Ordinance No. 13 for a little better description as to the exact location if you’re familiar with the Buckeye Club or if you’re familiar with the dead end of First Street NW before you pull into the Rec. Center’s parking lot this is exactly where this parcel is. There’s a half of a parcel and then there’s a full lot for which the city has been approached by an individual or individuals who are interested in purchasing these two parcels of land. Tonight we’ll give it a first reading and see what else may occur with this.
ORDINANCE NO. 6 – 2006 WAS GIVEN FIRST READING.
ORDINANCE NO. 14 – 2006 BY: POLICE AND FIRE COMMITTEE
COUNCILMAN MAIER –.Yes, this ordinance the intent here is to buy 2 marked police cars and 2 unmarked police cars for the Massillon Police Department. They are in need of these cruisers.

ORDINANCE NO. 15 – 2006 BY: POLICE AND FIRE COMMITTEE
COUNCILMAN MAIER – Yes, this ordinance is to fix some structural problems in the Number One Fire Station. They’ve been occurring and getting worse and I believe it’s in our best interest to get this done before it makes the building unsafe. We need to move ahead with this.

ORDINANCE NO. 15 – 2006 WAS PASSED BY A ROLL CALL VOTE OF 9 YES.
ORDINANCE NO. 16 – 2006 BY: PUBLIC UTILITIES COMMITTEE
COUNCILMAN MCCUNE – Yeah, this is an ordinance from Great Lakes Energy Partners on a Non-Surface Oil and Gas Lease in which they would be they shall be paid royalties share of 1/8 of the proceeds realized.

ORDINANCE NO. 17 – 2006 BY: STREETS, HIGHWAYS, TRAFFIC & SAFETY
COUNCILMAN PETERS – Yes, we discussed this at the work session last Monday. It is 100% reimbursable and funded.

COUNCILMAN PETERS – We also discussed this at the work session. I stated then that I think we need to move on this as quickly as possible trying to get these in before spring.

COUNCILMAN PETERS – Yes, this ordinance is to give them permission to pave our streets inside the city limits of Massillon. This would be from Finefrock down south to Erie to Lincoln Way and Lincoln Way to Hills and Dales.

COUNCILMAN PETERS – This is for resurfacing of the Route 30 that lies inside the city limits of Massillon.

ORDINANCE NO. 20 – 2006 WAS PASSED BY A ROLL CALL VOTE OF 9 YES.
ORDINANCE NO. 21 – 2006 BY: STREETS, HIGHWAYS, TRAFFIC & SAFETY
COUNCILMAN PETERS – This is a replat we talked about this also at the work session. They expressed concern that they need this passed as soon as they can.
COUNCILWOMAN FERRERO – Mr. Peters, I do have a couple of questions. We talked about this a little bit on Monday night about entrance to these lots. Because I went by there a couple of times to see what it would be like to have residents there and that’s really a dangerous place for people to get in and out of the way that traffic flow is. You mentioned that they’re going to be shared drives. (Well, Aane did, yeah) Is that for sure I mean how are they going to do that are these going to be individual residences or they are?
COUNCILMAN BRYAN – It’s zoned for single family; so I believe this would be just that single family residents.
COUNCILWOMAN FERRERO – But for them to have to share drives in brand new residences that doesn’t seem like that’s something that we do in today’s world so much.
COUNCILMAN MANG – Jayne, this pertains to some right-of-way only it does not pertain to the land is how it’s going to be developed. An individual has laid out plans to have lots off of Hankins and also off of Valerie. But this particular piece of legislation only really has to do with dedicating some land for right-of-way.
COUNCIL PRESIDENT GAMBER – Mr. Mang, if I could this ordinance accepts the replat.
COUNCILMAN MANG – That is correct, but we’re talking about here is the…
COUNCILWOMAN FERRERO – I guess I’m not quite clear as to what they are going to use this land for. Are they planning on putting 7 individual residences, 7 individual homes there?
COUNCILMAN PETERS – That’s what Aane said when he was here last Monday he didn’t tell us. (That’s the way this looks to me) Yeah, I mean that’s what he told us.
COUNCILWOMAN FERRERO – Personally, I don’t think sharing a drive is something that people do in today’s world. I rather see them have 4 plats of land and have their individual driveways or whatever. That’s all.
COUNCILMAN MANG – We have a typo in section 2, referring to Meadows Plaza.
COUNCIL PRESIDENT GAMBER – Mr. Peters what should section 2 reflect where it says Meadows Plaza? Mr. Mang, do you know? (No)
COUNCILMAN MCCUNE – I would like to echo Jayne’s concerns. I think that seems a little 1950’s on shared driveways and I do believe I drove by a couple of times too Jayne that is a very busy section of road right there.
COUNCIL PRESIDENT GAMBER – The Mayor had his hand up. Mr. Mayor, would like to come forward? Alright, where it says Meadows Plaza should be Concord Village.
ORDINANCE NO. 21 – 2006 WAS GIVEN FIRST READING.
ORDINANCE NO. 22 – 2006 BY: FINANCE COMMITTEE
COUNCILWOMAN CATAZARO-PERRY – There are 7 sections to Ordinance No. 22. Section 1, we’re going to be paying Bond Retirement Interest Golf and Bond Retirement Principal Golf. Section 2, we are going to zero out this account and so this $14,000.00 is going to also pay for this Bond Retirement Legends Fund. Section 3, is $25,000.00 for jail equipment. Section 4, is for our intersection study $23,000.00. Section 5, is $4,800.00 for parking permit contract and that is to pay SARTA for parking permits at their garage. Section 6, is $2,084.21 in I believe that is for the fire department and they had a check as well to support that amount and that is for a rescue boat. Section 7, is just to approve the ordinance. Are there any questions, Mr. Bill Hamit’s here and he can help answer those.

ORDINANCE NO. 22 – 2006 WAS PASSED BY A ROLL CALL VOTE OF 9 YES.
ORDINANCE NO. 23 – 2006 BY: FINANCE COMMITTEE
COUNCILWOMAN CATAZARO-PERRY – Ordinance No. 23 is allowing the Law Director to provide services for the City of Canal Fulton which he has done in the past. This is an annual contract.
COUNCILMAN BRYAN – Since the Law Director is here or Kathy if you know I understand that this is an increase in our fee from last year is that correct?
LAW DIRECTOR STERGIOS – To answer your question Mr. Bryan, Last year was either $19,000.00 or $20,000.00 is what was paid I believe it was $19,000.00 I could go look in the file. So we upped the price a little bit and there’s no exact science to it but it is for both of us a good deal because it’s cheaper than what it would cost Canal Fulton to hire their own or prosecute their own cases and our people are here so it’s sort of a fair resolution we’ve never had any trouble with them. So it’s at least a $2,000.00 increase.

ORDINANCE NO. 23 – 2006 WAS PASSED BY A ROLL CALL VOTE OF 9 YES.
ORDINANCE NO. 24 – 2006 BY: FINANCE COMMITTEE
COUNCILWOMAN CATAZARO-PERRY – This ordinance allows the Director of Public Service and Safety to enter into contract for the golf course, the street department, the wastewater treatment department and parks and rec. department. You all received the form the bid form last week I believe. This is an annual item as well and we rely on the Safety Service Director to receive those bids.

ORDINANCE NO. 24 – 2006 WAS PASSED BY A ROLL CALL VOTE OF 9 YES.
ORDINANCE NO. 25 – 2006 BY: FINANCE COMMITTEE
COUNCILWOMAN CATAZARO-PERRY – This ordinance will allow us to enter into contract with McCoy Associates which will allow an engineer to help us with the odor problem with the Wastewater Treatment Plant and this is also while we’re in the transition of not having an engineer on staff at the current time.
COUNCILMAN MANSON –.This is strictly for engineering services; this isn’t related just the Wastewater Treatment Plant. It’s any service that we may need in area that his PE.
COUNCILWOMAN CATAZARO-PERRY – That is correct I do believe my attachment focuses scope of service is mostly with the Wastewater Treatment Plant and it does list all the things that they are going to do. So maybe we should bring the Mayor up if we may.
COUNCILMAN BRYAN – We could save the Mayor a trip this is the wrong attachment. The attachment that starts with Appendix B says services of CTI Environmental. That should be the attachment for Ordinance No. 26 which I don’t have.
COUNCILWOMAN CATAZARO-PERRY – I don’t have that either.
COUNCILMAN BRYAN – So I think that’s just we just didn’t get Ordinance No. 26.
COUNCILWOMAN CATAZARO-PERRY – Okay, Ordinance No. 25 thank you very much Mr. Bryan. Ordinance No. 25 is for Steve Hamit he is going to be with McCoy Associates and he will be helping us through our transition and he will be available for consultations, meetings and related services on a needed basis as requested by the city. He will be billing us $120.00 per hour and we will invoice receive invoices on a monthly basis. So yes Mr. Manson he will be helping us in all areas of the city for engineering services.
COUNCIL PRESIDENT GAMBER – Who all has the attachment for Ordinance No. 25? Mrs. Catazaro-Perry what did you just read from?
COUNCILWOMAN CATAZARO-PERRY – This is from a letter from Mr. Mike Loudiana on January 24th. We did receive this at the work session last week if you can recall.
COUNCIL PRESIDENT GAMBER – Does everyone have a copy or remember receiving that copy last week? Is there anyone that needs a copy with the ordinance? Alight, now my understanding is we then have an attachment for Ordinance No. 26, but do not have the ordinance is that correct? Alright, what we’ll do is go through with the vote on Ordinance No. 25 and then our Clerk will get us Ordinance No. 26.

COUNCILWOMAN CATAZARO-PERRY – This ordinance is like Mary Beth said to enter into an agreement with CTI for the odor for the Wastewater Treatment Plant. I believe Mr. Manson has a few comments and I welcome any comments from other council members as well.
COUNCILMAN MANSON –.Yes, I talked to Mr. Ulrich at the Wastewater Treatment Plant several times over the last week. This is something we do not have to move on tonight and we can give this first reading. But what I wanted to bring up is if anybody has any questions about this and we had a pretty good presentation here at the last committee session get those questions to either to me, to the engineering officer or Mr. Ulrich. We also had some companies calling us about some recommendations they may have. Tell them to get it to either Mary Beth, myself, engineers or Mr. Ulrich and we will try to have those things answered by next Monday. We don’t have to move on this it’s not an emergency, but I don’t’ think we should wait to awful long we should keep moving on it and get it going. That’s it.
ORDINANCE NO. 26 – 2006 WAS GIVEN FIRST READING.
RESOLUTION NO. 2 – 2006 BY: COMMUNITY DEVELOPMENT COMMITTEE
COUNCILMAN MANG –.Yes, at our work session LW Associates came in and explained to you what they would like to do at Noble Place. They also had a meeting prior to coming to council with the residents of Noble Place. The gentleman indicated last at our work session that he still wanted to have another meeting. But we had already explained that this piece of legislation was going to go through the first, second and third readings. So tonight we’ll give it first reading.
COUNCIL PRESIDENT GAMBER – Mr. Mang, if I could ask you would you expand just a little bit for the benefit of the folks in the audience what exactly that means and what the developer will be doing while you’re doing the three readings.
COUNCILMAN MANG –.Well, basically by giving it three readings this piece of legislation will come back again to council in two weeks at our next council meeting and will come back again in two weeks from there at our third council meeting. At time you’re still may come down to council and voice your objects that’s what we’ve heard tonight or someone has support that will also be considered. At the night of third hearing at that time based on the information supplied to us by the residents of the area and the remarks by the councilman for the ward I’m sure all those things will be considered as to this piece of legislation.
RESOLUTION NO. 2 – 2006 WAS GIVEN FIRST READING.
RESOLUTION NO. 3 – 2006 BY: COMMUNITY DEVELOPMENT COMMITTEE
COUNCILMAN MANG –.At our work session last Monday night, PIRHL also presented to council a proposed senior housing development upon Walnut Road. Matter-of-fact tomorrow night I believe it’s at 6:00pm at the Friendship Baptist Church there will be a gathering of the people in the fourth ward to talk about this piece of legislation. Again, we’ll be giving it first reading tonight also giving the people in that area the opportunity to come to council at our second council meeting and also our third. But council will be looking at the ward council person to express interest or non-interest in the project.
RESOLUTION NO. 3 – 2006 WAS GIVEN FIRST READING.
RESOLUTION NO. 4 – 2006 BY: COMMITTEE OF THE WHOLE
COUNCILMAN BRYAN –.We have a Resolution 4, 5 and 6 tonight that deals strictly with number 4. First, Gloria Autrey served three terms on city council did an outstanding job for her ward and we want to commend her by passing Resolution No. 4 tonight. I won’t read it, but it in part credits her for her outstanding service to the citizens of Massillon and the fourth ward and later points out especially in the areas of Parks and Recreation.

COUNCILMAN BRYAN –.Councilwoman Lewis served for only a short time. She was appointed or elected by the Democratic Committee Precinct in her ward and served the remainder of term for Mr. Gamber. During that short time she did her best to provide excellent service for the people of Massillon and we wish to commend by passing Resolution No. 5.

RESOLUTION NO. 5 – 2006 WAS PASSED BY A ROLL CALL VOTE OF 9 YES.
RESOLUTION NO. 6 – 2006 BY: COMMITTEE OF THE WHOLE
COUNCILMAN BRYAN –.I will request now that after its passage this resolution and the other two be forwarded by the Clerk to the council members. This resolution commends Thomas Weber who served one term as a member of city council and was always cooperative and pleasant, upbeat and a good council member to work with.

COUNCILWOMAN CATAZARO-PERRY – Could we clarify for the members in the audience that they would like to come back for the second reading on that ordinance or Resolution No. 2 the date of our next meeting.
COUNCIL PRESIDENT GAMBER – Alright, to explain to anyone interested council meetings officially on the first and third Monday of each month. In this case, it’s February 21st due to President’s Day. The off Monday’s we meet at 5:45 for committee sessions those are much more informal and there’s a lot more discussion that goes on and you’re certainly invited to attend either the committee sessions on the 13th or the 27th.
17. REMARKS OF DELEGATIONS AND CITIZENS TO MATTERS NOT ON THE AGENDA
MICHAEL HENDERSON – I live over on 215 State Avenue, I’ve here about a year in the city limits so I’m kind of learning the ropes and everything. So I just have one thing that kind of struck me as a concern a daily concern and maybe I can talk to some of you and get clarification on this idea after the meeting here and get your view point on it. The traffic lights here in the town we have a lot of traffic lights here in the town that are on some major intersections I understand that Lincoln Way and Amherst and so forth. I’m sure most of you are pretty familiar with the town and everything. But my question is I want to know if there’s some of these traffic lights are in intersections that are not often traveled they run day and night, 24/7 forever and you know they obviously have time cycle they are triggered, they’re timed and I just wanted to know if anybody had any ideas on the feasibility to have some of these converted to either flashing lights on some of these less traveled intersections and I can’t get too specific but I would be happy to talk about that after the meeting or I said flashing lights or some that have timers where they would during the times they’re less busy that you have a stop one way of traffic maybe on less traveled road and the right-of-way for the other, or a four way stop or something of that nature. Something to be kicked around on that concept. I mean I find that I travel up State Avenue I’m sure you’re familiar from what First Street all the way up to Amherst to work or anywhere through the town and I’m sitting there wasting my time on intersections that are not often traveled. I mean I understand safety I got that, but you know wasting my time on lights that are just turning and then they turn and so forth. So I mean I wanted to throw that out for the council so you can kick that idea around I know that probably monies is involved if it were to go to timers and the light. But that’s a concern I feel it wastes a lot of time and I wondered how that can be done without compromising safety. So I want to throw that out your way if you want to talk to me afterwards. I live at 215 State; I’m not sure which council member has my district on that. But I just wanted to throw that out. So….
COUNCIL PRESIDENT GAMBER – Mr. Henderson, to your left Don Peters if you’ll raise your please. Mr. Peters is chairman of our Streets and Highways Department, so I would suggest the two of you get together afterwards and then Mr. Peters can bring something forward at the committee session. COUNCILWOMAN FERRERO – So you’re creating awareness to council that you want a skate park. You know that’s park of our passion as well. We would love to see that happen in our community and I’m sure the Parks and Rec. are working on that.
MATTHEW SEIGFIELD – I live at 29 Maple. Let me say first and foremost Mr. Maier I am very sorry for your lost. I am here tonight to speak on behalf of my son who is very determined to have a skate park. No one here is more surprised at his determination than I am. I asked him, he asked me “what can I do to get this thing built” I looked at him and I said “you need to convince City Hall” plain and simple. So he came back here tonight with his heart poured out on a piece of paper in order to make an attempt to let you know that one, not all skateboarders are bad. You know there are vandals out there and there’s always going to be vandals that’s one the things when I was speaking with people handing out flyers with him brought up to me is will a skate park stop all vandals? No. it’s not there’s been people tearing things up way before there was skateboards. Two, should the taxpayers bear all the cost for the skate park? Of course, there’s people out there we’re talking to in hopes of getting some sort of helping financing and so on and so forth. Thank you for your time unfortunately I’m not as prepared as my son I had a grand speech written, but I lost it.
COUNCIL PRESIDENT GAMBER – Mr. Seigfield, over the last several weeks we’ve had a number of young people come in and talk about the skateboard issue. I’ve reminded everyone each time that the Park and Rec. Department does have an ongoing project going and I’ll ask again. Have you been to the Park and Rec. Department, have you seen where they’re at and what they’re doing? If not that’s my advise to you go to the Park and Rec. Department tell them you would like to participate on that committee because I know their at the past the point of site selection and they’re probably in the area of planning what the park would consist of. So I appreciate you all coming here which is fine, but the Park and Rec. Department has a plan they’re working on and you can get involved and influence it from that end before it comes to council.
